Welcome to MailMergic. These Terms of Service (“Terms”) govern your use of the MailMergic website and the MailMergic Offline Application (the “Software”). By accessing our website or downloading the Software, you agree to be bound by these Terms.
1. Software License & Local Usage
MailMergic GmbH grants you a non-exclusive, non-transferable license to use the Software strictly on your local hardware.
- Offline Nature: The Software is designed to function without an internet connection for its core operations (Mail Merge).
- License Validation: An internet connection is not required.
- Prohibited Actions: You may not reverse engineer, decompile, or attempt to extract the source code of the Software.
2. User Responsibilities & Content
Since the Software operates locally on your machine, MailMergic GmbH does not have access to, nor control over, the data you process.
- Compliance: You are solely responsible for ensuring that your use of the Software complies with all applicable local laws, including the Personal Information Protection Law (PIPL).
- Data Handling: You represent that you have the legal right to process the data (Excel files, PDF templates) you use within the Software.
3. Payment and Refunds
Payments are processed through our global merchant of record, Paddle. By completing a purchase, you agree to Paddle’s terms and conditions.
- Trial Period: We provide a free trial version to ensure the Software meets your needs before purchase.
- Refund Policy: We offer a 30-day money-back guarantee if the Software does not perform as described, provided you have contacted support to attempt a resolution.
4. Limitation of Liability
To the maximum extent permitted by law, MailMergic GmbH shall not be liable for any data loss, business interruption, or indirect damages resulting from the use of the Software. Because the Software runs locally, the security of the processing environment is the sole responsibility of the user.
5. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany. If you are a business user or a legal entity, the exclusive place of jurisdiction for all disputes arising from this contract is Frankfurt am Main, Germany.
6. Termination
We reserve the right to terminate your license if you violate these Terms (e.g., unauthorized distribution of the Software). Upon termination, you must cease all use of the Software and delete all copies.
